TheJetGrade Terms of Service

1. What these terms cover

These Terms govern your use of thejetgrade.com and any TheJetGrade subdomain, app, newsletter, tool or content we operate (together, the "Site"). By using the Site you agree to these Terms and to our Privacy Policy and Cookie Policy, which are part of these Terms. If you don't agree, don't use the Site.

You must be at least 18 to use the Site. The Site is intended for people evaluating, buying, owning, selling or servicing aircraft, and for the professionals who serve them.

2. What TheJetGrade is, and is not

TheJetGrade publishes editorial information about aircraft: grades, specifications, cost estimates, market commentary, value estimates, aircraft history summaries and buyer guides. TheJetGrade also offers aircraft brokerage and referral services under separate written agreements.

TheJetGrade is not:

• an appraiser. Grades and value estimates are not appraisals and are not prepared under USPAP or any appraisal standard;
• a pre-purchase inspection facility, maintenance provider or airworthiness authority;
• an air carrier or air charter broker. TheJetGrade does not arrange flights;
• a lender, insurer, escrow agent, title company, tax advisor or attorney;
• a party to any aircraft transaction unless it has signed a written brokerage or representation agreement with you.

Nothing on the Site is an offer to buy or sell an aircraft, a guarantee of any aircraft's condition, value or availability, or professional advice of any kind. You are responsible for your own decisions and for obtaining a pre-purchase inspection, a title search, an appraisal and independent legal, tax and financial advice before any aircraft transaction.

3. Grades, estimates and data

Grades are editorial opinions. They reflect the judgment of TheJetGrade's editors as of the date shown and may change without notice. Grades are not influenced by advertising, sponsorship or affiliate relationships (see Section 9).

Value estimates are generated from published asking prices, public records and editorial models. They are informational only, may be materially wrong for any specific aircraft, and must not be relied on for lending, insurance, tax, estate, litigation or transaction purposes.

Aircraft data on the Site is compiled from public sources (including FAA and NTSB records), manufacturer publications, published market reports and our own research. Public records contain errors, lag real-world events and omit information. We do not verify every record. Specifications vary by serial number, configuration and modification. Always confirm against the aircraft's own records and the manufacturer's current documentation.

Tail-number reports summarize public records associated with a registration number. A report is not a title search, does not establish ownership, liens, damage history, airworthiness or maintenance status, and does not replace a review of the aircraft's logbooks.

4. Your account and submissions

Some features require an account or a form submission. You agree to give accurate information and to keep your login confidential. You are responsible for activity under your account.

When you submit content (a tail number, aircraft records, logbooks, photographs, listing details, comments, quiz answers or anything else), you:

• confirm you have the right to submit it and that it does not violate anyone's rights or any confidentiality obligation;
• confirm it does not contain another person's personal information unless you are authorized to share it;
• grant TheJetGrade a non-exclusive, worldwide, royalty-free license to store, reproduce, analyze, display and create derivative works from it for the purpose of operating and improving the Site and its services, including generating grades, estimates and reports;
• understand that we may cross-check submissions against public records and that we are not obligated to publish, grade or act on any submission.

We may remove any submission at any time. We do not claim ownership of your logbooks or records.

5. Leads, contact and communications

If you submit a form, request a snapshot, download a guide, ask to sell an aircraft or contact us, you consent to TheJetGrade contacting you by email and, if you provided a phone number, by phone or text message, about your request and related services. Message and data rates may apply. You can opt out of marketing email by using the unsubscribe link, and of texts by replying STOP.

If your request concerns an aircraft type or service TheJetGrade does not personally handle, we may refer you to a partner broker or service provider and may receive a referral fee. We tell you when we do this. See the Privacy Policy for how we share your information.

6. Brokerage and referral services

Any brokerage, buyer representation, seller representation or transaction advisory service is provided only under a separate written agreement that sets out scope, fees and obligations. These Terms do not create a brokerage, agency or fiduciary relationship. Until such an agreement is signed, communications with TheJetGrade about an aircraft are informational and non-exclusive.

7. Third-party listings, links and sponsors

The Site links to and features aircraft listings, products and services offered by third parties (brokers, dealers, manufacturers, sponsors, affiliates). We do not own, inspect or guarantee any listed aircraft, and we are not responsible for third-party content, pricing, availability, terms, or conduct. Your dealings with any third party are solely between you and them.

8. Intellectual property

The Site, its design, text, grades, scoring methodology, databases, images, logos and software are owned by TheJetGrade or its licensors and protected by copyright, trademark and database laws. You may view and print pages for personal, non-commercial use. You may not copy, scrape, crawl, frame, mirror, republish, sell, or build a dataset or product from Site content without our written permission. Automated access is prohibited except by search engines indexing public pages in accordance with our robots.txt.

"TheJetGrade" and the TheJetGrade badge are trademarks of TheJetGrade LLC. Other names and marks belong to their owners and are used for identification only; their use does not imply endorsement.

9. Advertising, sponsorship and affiliate relationships

The Site is supported by advertising, sponsorships and affiliate links. Sponsored placements are labeled "Advertisement" or "Sponsored." Affiliate links are labeled, and TheJetGrade may earn a commission if you buy through them, at no extra cost to you. Sponsors and affiliates have no input into grades, scores, rankings or editorial content. See our Advertising and Affiliate Disclosure.

10. Acceptable use

You agree not to: use the Site for any unlawful purpose; submit false, misleading or infringing content; attempt to access accounts, systems or data you are not authorized to access; interfere with the Site's operation; scrape or harvest data or contact details; use the Site to send unsolicited communications; or misrepresent your affiliation with TheJetGrade.

11. Disclaimer of warranties

THE SITE AND ALL CONTENT, GRADES, ESTIMATES, REPORTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY INFORMATION IS CURRENT, CORRECT OR SUITABLE FOR ANY DECISION.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THEJETGRADE AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, DIMINUTION IN VALUE, OR THE COST OF ANY AIRCRAFT, INSPECTION, REPAIR OR TRANSACTION, ARISING FROM OR RELATED TO THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THEJETGRADE FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain limitations; in those places these limits apply to the fullest extent permitted.

13. Indemnification

You will defend, indemnify and hold harmless TheJetGrade and its affiliates from any claim, loss or expense (including reasonable attorneys' fees) arising from your submissions, your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

14. Copyright complaints

If you believe content on the Site infringes your copyright, follow the process in our DMCA Policy.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, including for any violation of these Terms. Sections 3, 4, 8, 11, 12, 13, 16 and 17 survive termination.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.

Any dispute arising from these Terms or the Site will be resolved by binding individual arbitration administered by JAMS under its rules, in Allentown, Pennsylvania or remotely. You and TheJetGrade waive any right to a jury trial and to participate in a class action. You may opt out of this arbitration clause by emailing legal@thejetgrade.com within 30 days of first accepting these Terms. Small-claims matters may be brought in small-claims court.

17. General

These Terms, the Privacy Policy, the Cookie Policy and the disclosures referenced in them are the entire agreement between you and TheJetGrade about the Site. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. We may change these Terms by posting a revised version with a new effective date; continued use after the change is acceptance.
